The arbitrator's decision shall be final and binding.

Each party shall bear its own costs and attorney's fees, unless otherwise determined by the arbitrator.

Class Action Waiver

You and V&D FASHION agree that claims may only be brought against the other party in an individual capacity and not as a plaintiff or class member in any purported class action, consolidated action, or representative action.

Exceptions

Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.

Small Claims Court

Either party may bring an individual action for disputes falling within the jurisdiction of small claims court.

12. Product Liability
